Toxicity

According to EPA 40 CFR 261.24, a solid waste exhibits the characteristic of toxicity if a representative sample of the waste has any of the following properties:

  • When tested using the TCLP procedure, the extract contains any of the contaminants listed in the table (Table 1) at a concentration equal to or greater than the respective value given.
  • When tested using the Waste Extraction Test (WET), the extract contains any of the contaminants listed in the table (Table 2) at a concentration equal to or greater than its soluble threshold limit concentration (STLC) or its listed total threshold limit concentration (TTLC).
  • It has an acute oral LD50 less than 5,000 milligrams per kilogram.
  • It has an acute dermal LD50 less than 4,300 milligrams per kilogram.
  • It has an acute inhalation LC50 less than 10,000 parts per million as a gas or vapor.
  • It has an acute aquatic 96-hour LC50 less than 500 milligrams per liter when measured in soft water (total hardness 40 to 48 milligrams per liter of calcium carbonate) with fathead minnows, rainbow trout, or golden shriners.
  • It contains any of the following substances at a single or combined concentration equal to or exceeding 0.001 percent by weight:
    • 2-Acetylaminoflourene (2-AAF)
    • Acrylonitrile
    • 4-Aminodiphenyl
    • Benzidine and its salts
    • bis(Chloromethyl)ether (BCME)
    • Methyl chloromethyl ether
    • 1,2-Dibromo-3-chloropropane (DBCP)
    • 3,3'-Dichlorobenzidine and its salts (DCB)
    • 4-Dimethylaminoazobenzne (DAB)
    • Ethyleneimine (EL)
    • alpha-Napththylamine (1-NA)
    • beta-Napththylamine (2-NA)
    • 4-Nitrobipheyl (4-NBP)
    • n-Nitrosodimethylamine (DMN)
    • beta-Propiolactone (BPL)
    • Vinyl chloride (VC)
  • It has been shown through experience or testing to pose a hazard to human health and environment because of its carcinogenicity, acute toxicity, chronic toxicity, bioaccumulative properties or persistence in the environment.
